Hand Tool Warranty 1. WARRANTY: Subject to the limitations expressed herein, Seller warrants to the original Buyer that hand tools manufactured and sold by Seller (“Tool”) shall be free from defects in design, material and workmanship under Normal Use for the life of tool. This warranty is void for any damage caused by misuse, abuse, neglect, or acts of God. For the purpose of this section, “Normal Use” means in strict accordance with any documentation describing safe practices used by a professional tradesman in the industry. 2. REMEDIES: Seller shall replace at no additional charge any tool that it receives from the original buyer not conforming to the warranty set forth herein. Seller hereby disclaims all other expressed or implied warranties, including, without limitation, all implied warranties of merchantability and fitness or fitness for a particular purpose. 3. LIMITATION OF LIABILITY: Under no circumstances shall either party be liable to the other for incidental, punitive, special or consequential damages of any kind. Buyer hereby acknowledges and agrees that under no circumstances, and in no event, shall seller’s liability, if any, exceed the net sales price of the tool. 4. LABOR ALLOWANCE: Seller makes no additional allowance for the labor, shipping or other expense incurred by buyer to return, repair or replace the tool or damage resulting from the same. Waterworks Tool Warranty ONE YEAR LIMITED WARRANTY All parts for RAPTOR Waterworks Tools are warranted to the original consumer purchaser to be free from defects in material and workmanship for a period of one (1) year. This warranty is made to the original consumer purchaser and shall be effective from date of purchase as shown on purchaser’s receipt. RAPTOR will replace, free of charge, during the warranty period, any part which proves defective in material and/or workmanship under normal installation, use and service. RAPTOR’s obligation under this warranty shall be limited to the replacement of any part or parts which prove defective upon inspection by a local RAPTOR Dealer, transportation charges prepaid, with a copy of the purchase receipt. This warranty is the only express warranty made by raptor and is limited to the duration of this warranty and all other express or implied warranties, whether implied by operation of law or otherwise, including, without limitation, all implied warranties of merchantablility and fitness or fitness for a particular purpose, are for personal injury or property damage or any other loss, damage, cost of repairs or incidental, punitive, special or consequential damages of any kind, whether based upon warranty, contract, strict liability, design, manufacture, sale, transportation, installation, use or repair of the products sold by raptor. Buyer hereby acknowledges and agrees that under no circumstance, and in no event, shall raptor’s liability, if any, exceed the replacement of the defective product(s); no additional allowance shall be made for the labor or expense of repairing or replacing defective products or workmanship or damage resulting from the same. Except as expressly set forth in this paragraph, all products and/or services provided by raptor and its employees and agents are provided “as is,” “where is,” “and “with all faults.” Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty is void for any damage to the RAPTOR product due to misuse, abuse, neglect, accident, improper installation, any use in violation of instructions furnished by us, or any use of replacement parts other than genuine RAPTOR parts. Extension Cord and Accessory Warranty ONE YEAR LIMITED WARRANTY All parts for RAPTOR extension cords and electrical accessories are warranted to the original consumer purchaser to be free from defects in material and workmanship for a period of one (1) year. This warranty is made to the original consumer purchaser and shall be effective from date of purchase as shown on purchaser’s receipt. RAPTOR will replace, free of charge, during the warranty period, any part which proves defective in material and/or workmanship under normal installation, use and service. Measuring Tape Replacement Circumstances: Missing rivets Tape shows no obvious signs of abuse or misuse but is missing one or more rivets from tape hook Defective retraction Tape shows no obvious signs of abuse or misuse but blade will not retract into the case fully Broken spring Tape shows no obvious signs of abuse or misuse but blade will not return into the case or has come out of case altogether Defective part Tape shows no obvious signs of abuse or misuse but one or more parts is broken or missing Circumstances not covered by warranty: Torn, cut, ripped or twisted blade Shows obvious signs of being dropped or damaged by neglect Bent hook Shows obvious signs of being dropped or damaged by neglect Rusty Blade Indicates that the tape and blade have been exposed to high levels of moisture for extended periods Foreign material on blade or case Examples: paint, roofing tar, tile cement, caulk, etc. Worn beyond the tape’s expected life Missing numbers and bare metal on blade show that the tape is worn out Abused or mistreated Broken case, kinked blade, shattered parts are obvious that the tape has been mistreated
